Terms of Service

These terms govern your use of Atomo, a shared knowledge workspace for people and their AI tools, available at atomo.dev. By creating an account or using the service you agree to them. They're written to be read — if anything is unclear, ask us.

1. Who we are

Atomo is operated by atomo.dev, based in Austria. In these terms, "we", "us" and "Atomo" refer to that operator. You can reach us at hello@atomo.dev.

2. The service

Atomo lets you organise knowledge into workspaces, spaces, sections and entries, and lets AI tools you authorise (via agent keys and the MCP protocol) read and write in that workspace on your behalf. Features may evolve; we aim to improve the service, not to surprise you.

3. Your account

You need an account with a valid email address to use Atomo. Keep your password and your agent keys confidential — actions taken with your credentials or your keys count as your actions. Tell us promptly if you believe an account or key has been compromised.

4. Your content

Everything you or your connected agents put into your workspace stays yours. You grant us only the technical licence needed to store, process, back up and display that content to you and the agents you authorise — nothing more. We don't claim ownership and we don't use your content for advertising.

5. AI agents and keys

Agent keys let external AI tools act inside your workspace with their own attributed identity. You choose which tools to connect and what they do; you are responsible for the actions of tools you connect. You can rotate or revoke a key at any time, which cuts that tool's access immediately.

Optional AI-assisted features (such as writing suggestions) send the relevant text excerpt to an AI provider to generate the result. These features are optional and off wherever no provider is configured.

6. Acceptable use

  • Don't use Atomo for anything unlawful, or to store or distribute content that infringes others' rights.
  • Don't attempt to break, probe or overload the service, other people's workspaces, or the authentication and rate limits that protect them.
  • Don't resell or provide access to the service to third parties except through the sharing and agent features we provide.

7. Plans and payment

The free plan is genuinely free — no card required. The paid Pro plan is currently in beta and not yet available for purchase: we don't charge anyone at this time.

During the beta phase we may offer Pro features free of charge. Beta access is time-limited and may end or change with notice — your content stays readable and exportable, and adding more is then subject to your plan's limits.

When Pro opens, paid plans will add capacity (spaces, sections, entries, agent keys, storage) at the limits and price shown when you subscribe. Subscriptions renew automatically for each billing period (currently monthly) until you cancel.

We may change prices or plan limits for future billing periods: we'll notify you in advance (for example by email or an in-app notice) before a new price takes effect, a change never affects a period you've already paid for, and you can cancel any time before renewal so the new price simply never applies to you.

We may also adjust the free plan's limits with advance notice. If a lowered limit leaves you over it, your existing content stays readable and exportable — you just can't add more until you're under the limit or upgrade.

8. Availability

We work to keep Atomo fast and available, but it is provided "as is" without a guaranteed service level. We may perform maintenance, and we may modify or discontinue features; features marked beta or preview may change or be withdrawn without notice.

Parts of Atomo depend on third-party providers (hosting, email delivery, AI providers). If a provider fails, changes its terms or reprices, we may switch providers or adjust, limit or suspend the affected feature. We're not responsible for failures caused by events beyond our reasonable control.

9. Data and backups

We back up the service regularly, but no system is immune to failure — keep your own exports of anything you can't afford to lose. Data loss is subject to the liability limits below.

10. If we shut down

Atomo is a small, young service. If we ever have to discontinue it, we'll give you as much notice as circumstances allow — our target is at least 30 days — so you can export your content, and we'll refund the unused part of anything you've prepaid pro-rata.

11. Termination

You can stop using Atomo and delete your account at any time. We may suspend or terminate accounts that violate these terms or put the service or other users at risk; where reasonable, we'll warn you first.

12. Liability

To the extent permitted by law, we are not liable for indirect or consequential damages (including loss of profits and loss of data), and our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot lawfully be limited, and none of this affects your statutory rights as a consumer.

13. Changes to these terms

We may update these terms as the service evolves. For material changes we'll notify you (for example by email or an in-app notice) before they take effect. Continuing to use Atomo after that means you accept the updated terms.

14. Governing law

These terms, and any dispute arising from them or from your use of Atomo, are governed by the laws of Austria, without regard to its conflict-of-law rules. The courts of Austria have jurisdiction.

If you use Atomo as a consumer, nothing here deprives you of the protection of the mandatory consumer-law provisions of the country where you live, including your right to bring proceedings there where local law grants it.

If any provision of these terms turns out to be invalid, the rest stays in effect.
